Terms of Service

These Terms of Service ("Terms") govern your access to and use of Captain Arbash Pro Training System (the "Service"), operated by Captain Arbash Pro Training System ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Captain Arbash Pro Training System is a subscription-based software platform for personal trainers and fitness coaches, providing tools for client assessment, training and nutrition plan creation, progress tracking, AI-assisted posture analysis, and related coaching features.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

3. Subscriptions & Billing

• The Service is offered on a recurring monthly subscription basis (Starter and Pro plans).
• New accounts receive a 7-day free trial. You may cancel at any time during the trial at no charge.
• After the trial period, your subscription will automatically renew monthly unless cancelled, and payment will be charged via our payment processor, Lemon Squeezy (lemonsqueezy.com).
• All payments are processed securely by Lemon Squeezy, who acts as the Merchant of Record for these transactions.

4. Cancellations & Refunds

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refund requests are handled in accordance with Lemon Squeezy's buyer terms and are evaluated on a case-by-case basis.

5. Acceptable Use

You agree not to misuse the Service, including but not limited to: attempting unauthorized access, reverse-engineering the platform, copying, cloning or reproducing its code, design, text or features, or using the Service for any unlawful purpose.

Captain Arbash Pro, its name, logo, source code and content are the intellectual property of Khaled Arbach. All rights reserved. No part may be copied, redistributed or used to build a competing product without prior written permission.

6. Client Data

As a trainer using the Service, you are responsible for obtaining appropriate consent from your clients before entering their personal or health-related data into the platform. You retain ownership of your client data.

7. Arbash Marketplace ("Story")

Arbash Marketplace is an optional, separately-priced add-on that lets a trainer or gym owner ("Merchant") rent a public storefront within the Service to list and sell their own dietary supplements and fitness products to their own clients and to the public. By activating Arbash Marketplace, the Merchant agrees to the following additional terms:

• Sole responsibility: The Merchant is solely and fully responsible for the legality, safety, quality, labeling, licensing, and regulatory compliance of every product they list. Captain Arbash Pro Training System and its owner take on no responsibility whatsoever for any product sold through a Merchant's store.
• Platform role: The Service only rents the storefront tool. We are not a party to, and receive no commission from, any sale between a Merchant and their customer. All payment for products is arranged and settled directly between the Merchant and their customer (e.g. via WhatsApp), entirely outside the Service. The only payment collected by the Service is the recurring rental fee for the Arbash Marketplace feature itself.
• Prohibited products: Displaying, advertising, or selling anabolic steroids, or any other controlled, illegal, or banned substance, through an Arbash Marketplace storefront is strictly prohibited.
• Consequence of violation: Any violation of the prohibited-products rule, or of applicable law, results in immediate and permanent suspension of the Merchant's entire account on the Service (not only the Marketplace feature), with no refund of any fees paid, and full disclaimer of liability by the Service and its owner for any resulting harm, claim, or loss.
• Reports and store names: Any visitor may report a store, and we may review reports and disable any non-compliant storefront at any time. Store names must not suggest an official or affiliated status, must not use third-party brand names without authorization, and product listings must not make misleading health or therapeutic claims.
• No warranty of sales: We do not guarantee any level of visibility, traffic, or sales for any storefront.

8. AI-Assisted Features

Posture analysis and other AI-assisted features are provided as guidance tools to support your professional judgment. They are not a substitute for medical or physical therapy diagnosis, and should be used alongside your own professional expertise.

Master Coach · Expert Eye provides general written fitness feedback on a training plan you submit. It is not medical advice or a diagnosis, does not replace consulting your doctor before starting or changing exercise, and no specific result is guaranteed. Pro subscriptions include one review request per 30 days; the Personal Master Coach package is arranged separately.

Free trial and uploaded files: if your 7-day free trial ends without a paid subscription, photos and videos uploaded to your account are deleted 7 days later. Subscribe before then to keep them.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any damages arising from products sold through Arbash Marketplace.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
